HONESDALE, PA - October 27, 2011
The following cases were addressed by the Honorable Raymond L. Hamill, President Judge, Wayne County:

Sean Patrick Mcallister, age 22 of Honesdale, PA was sentenced to the Wayne County Correctional Facility for a period of not less than 13 months nor more than 5 years less one day for one count of Criminal Trespass-Break Into Structure, graded as a Felony of the 3 Degree, one count of Firearms Not to be Carried Without a License, graded as a Misdemeanor of the 1 Degree, one count of Criminal Mischief, st graded as a Misdemeanor of the 2nd Degree and one count of Resisting Arrest or Other Law Enforcement, also graded as a Misdemeanor of the 2nd Degree. He was also ordered to pay all Court costs, pay a fine in the amount of $250.00, pay restitution in the amount of $1,500.00, undergo a mental health evaluation and comply with all recommendations for treatment, attend and complete an anger management program submit to the drawing of a DNA sample and pay $250.00 for the cost of the sample, and have no contact with the victim in this matter. The incident occurred on Dec. 5, 2010, in Hawley Borough when McAllister entered a private residence with a loaded semi automatic pistol.  

Tammy Donaldson, age 42 of Staten Island, NY was placed on probation for a period of 18 months for one count of Receiving Stolen Property, graded as a Misdemeanor of the 1 Degree. She was also ordered to pay all Court costs, pays restitution in the amount of $1,770.00 pay $300.00 for the cost of the public defender and obtain full time employment. The incident occurred on Jan. 25, 2011, in Honesdale Borough when Donaldson pawned jewelry which was stolen from a local business.  

Jenny Mae Faatz, age 43 of Honesdale, PA was sentenced, in two separate cases, to the Wayne County Correctional Facility for a period of not less than 10 days or more than 12 months for two counts of DUI-Highest Rate, both ungraded Misdemeanors. She was also ordered to pay all Court costs, pay a fine in the amount of $2,000.00, attend and complete an alcohol highway safety program, continue with mental health treatment, obtain full time employment and pay $600.00 for the cost of the public defender. The first incident occurred on Mar. 12, 2011, in Mt. Pleasant Township when Pennsylvania State Police were called to investigate the report of a one vehicle crash. Her BAC was .251%. The second incident occurred on May 21, 2011, in Waymart Borough when Waymart Borough Police observed Faatz drive over a curb. Her BAC was .257%.

John Paul Peter Reck, age 32 of Lake Ariel, PA was sentenced to the Wayne County Correctional Facility for a period of not less than 3 months nor more than 12 months  for one count of Possession of Drug Paraphernalia, an ungraded Misdemeanor.  He was also ordered to pay all Court costs, pay a fine in the amount of $300.00 and undergo a drug and alcohol evaluation and comply with all recommendations for treatment. The incident occurred on Feb. 26, 2011, in Sterling Township when Reck was discovered to be in possession of a crack pipe.

John Horn, age 48 of Clark Summit, PA was sentenced to the Wayne County Correctional Facility for a period of not less than 5 days nor more than 12 months for one count of Possession of Drug Paraphernalia, an ungraded Misdemeanor.  He was also ordered to pay all Court costs, undergo a drug and alcohol evaluation and comply with all recommendations for treatment, obtain full time employment upon being released from prison and perform 50 hours of community service. The incident occurred on Feb. 26, 2011, in Sterling Township Horn was found to be in possession of a crack pipe.

William L. Teeple, age 24 of Equinunk, PA was sentenced to the Wayne County Correctional Facility for a period of not less than 72 hours nor more than 6 months for one count of DUI-Highest Rate, an ungraded Misdemeanor.  He was also ordered to pay all Court costs, pay a fine in the amount of $1,000.00, undergo a drug and alcohol evaluation and comply with all recommendations for treatment, attend and complete an alcohol highway safety program, obtain full time employment upon being released from prison and perform 50 hours of community service.  The incident occurred on Feb. 23, 2011, in Berlin Township when Pennsylvania State Police were called to investigate the report of a one vehicle crash.  His BAC was .173%.

Marisa Lyn Peters, age 25 of Carbondale, PA was placed on probation for a period of 12 months for one count of Theft By Deception-False Impression, graded as a Misdemeanor of the 2nd  Degree. She was also ordered to pay all Court costs, pay restitution in the amount of $646.66, pay $300.00 for the cost of the public defender, undergo a drug and alcohol evaluation together with a mental health evaluation and comply with all recommendations for treatment and obtain full time employment. The incident occurred between Mar. 21, 2011 and Mar. 22, 2011, in Honesdale Borough when Peters passed two bad checks to a local business owner.  

Brian Allen Matthews, age 25 of Honesdale, PA was sentenced to the Wayne County Correctional Facility for a period of not less than 72 hours nor more than 6 months for one count of DUI-Highest Rate, an ungraded Misdemeanor.  He was also ordered to pay all Court costs, pay a fine in the amount of $1,500.00, undergo a drug and alcohol evaluation and comply with all recommendations for treatment, and perform 50 hours of community service.

Charles Robert Callahan, age 31 of Hawley, PA was sentenced to the Wayne County Prison for a period of not less than 9 months nor more than 23 1⁄2 months for one count of Endangering Welfare of Children: As Parent/Guardian, graded as a Misdemeanor of the 1st Degree and one count of Recklessly Endangering Another Person, graded as a Misdemeanor of the 2nd Degree.  He was also ordered to pay all Court costs, pay for victim counseling, pay $300.00 for the cost of the public defender, attend and complete an anger management program, undergo a mental health evaluation and comply with all recommendations for treatment, obtain full time employment upon being released from prison and have no contact with the victims in this matter.  The incident occurred on June 12, 2011, in Paupack Township when Callahan physically assaulted two female children.

Margit Anita Deppert, age 20 of Lakeville, PA was placed on probation for a  period of 6 months for one count of Possession of Drug Paraphernalia, an ungraded Misdemeanor.  She was also ordered to pay all Court costs, pay a fine in the amount of $200.00, and perform 20 hours of community service.  The incident occurred on May14, 2011, in Hawley Borough when Deppert was discovered to be in possession of Percocet, Vicodin and Marijuana.   

Sherry Lynn Buccelli, age 44 of Hamlin, PA was placed on the Accelerated Rehabilitative Disposition Program for a period of 6 months related to DUI.  She was also ordered to pay all Court costs, perform 40 hours of community service, attend and complete an alcohol highway safety program and have her operator’s license suspended for a period fo 60 days.  The incident occurred on June 9, 2011, in Palmyra Township when Pennsylvania State Police were called to investigate the report of a one vehicle crash.  Her BAC was .226%.

Brittany Ann Burger, age 22 of Lake Ariel, PA was placed on the Accelerated Rehabilitative Disposition Program for a period of 6 months related to DUI.  She was also ordered to pay all Court costs, perform 40 hours of community service, attend and complete an alcohol highway safety program, and have her operator’s license suspended for a period of 30 days.  The incident occurred on July 3, 2011, in Salem Township when Pennsylvania State Police were called to investigate the report of a one vehicle crash. Her BAC was .14%.

James Frank Roon, age 28 of Forest City, PA was placed on the Accelerated Rehabilitative Disposition Program for a period of 6 months related to DUI.  He was also ordered to pay all Court costs, perform 40 hours of community service, attend and complete an alcohol highway safety program, and have his operator’s license suspended for a period of 60 days.  The incident occurred on July 23, 2011, in Mt. Pleasant Township when Pennsylvania State Police were called to investigate the report of a one vehicle crash.  His BAC was .205%.  

Jose Manuel Pena, age 27 of Honedsale, PA pled guilty to one count of DUI-Highest Rate, graded as a Misdemeanor of the 1st Degree.  The incident occurred on April 30, 2011, in Honesdale Borough when Honesdale Borough Police observed Pena traveling at a high rate of speed.  His BAC was .202%.  He is scheduled to be sentenced on Dec.15, 2011.

Dane Robert Craig, age 45 of Clarks Summit, PA pled guilty to two counts of Theft By Unlawful Taking, both graded as Misdemeanors of the 2  Degree. The incidents occurred between May 1, 2010, and Nov. 5, 2010, in Waymart Borough when Craig stole and consumed approximately thirty-six thousand Hydrocodone pills while serving as a pharmacist at a local pharmacy.  He is scheduled to be sentenced on Dec. 15, 2011.     

Timothy Lee Gibbons, age 22 of Honesdale, PA pled guilty to one count of Delivery of Controlled Substance, an ungraded Felony.  The incident occurred between July 7, 2010, and July 27, 2010, in Dyberry Township when Gibbons sold a controlled substance to a confidential informant.  He is scheduled to be sentenced on Dec. 8, 2011.

John Vincent Zurlo, age 20 of Greentown, PA pled guilty to one count of DUI-(Minor), an ungraded Misdemeanor.  The incident occurred on April 30, 2011, in Dreher Township during a Pennsylvania State Police check point.  His BAC was .040%.  He is  scheduled to be sentenced on Dec. 8, 2011.

Daniel P. McDonogh, age  21 of Honesdale, PA pled guilty to one count of DUI or Controlled Substance, an ungraded Misdemeanor.  The incident occurred on April 23, 2011, in Texas Township when Pennsylvania State Police were called to investigate the
report of a one vehicle crash.  His BAC was .185%.  He is scheduled to be sentenced on Dec. 8, 2011.

Diane Long, age 48 of Allentown, PA pled guilty to one count of Bad Checks, graded as a Misdemeanor of the 1st Degree.  The incident occurred on Mar. 19, 2011, in Lehigh Township when Long passed a check on a closed account.  She is scheduled to be sentenced on Dec. 15, 2011.

Daniel A. Weiss, age 18 of Scranton, PA pled guilty to one count of Receiving Stolen Property, graded as a Misdemeanor of the 1st Degree. The incident occurred on Sept. 5, 2010, in Salem Township when Weiss was discovered to be in possession of a stolen dirt bike.  He is scheduled to be sentenced on Dec. 15, 2011.

Matthew Norman Anderson, age 23 of Honesdale, PA pled guilty, in two separate cases, one count of Fleeing or Attempting to Elude a Police Officer, graded as a Misdemeanor of the 2nd Degree and one Count of Driving While Operating Privileges Suspended/Revoked, graded as a Summary offense, and one count of False Reports to Law Enforcement Authorities, graded as a Misdemeanor of the 3 Degree. The first incident occurred on May 31, 2011, in Honesdale Borough when Honesdale Borough Police observed Anderson traveling at a high rate of speed. The second incident occurred on June 1, 2011, in Damascus Township when Anderson reported his vehicle stolen, knowing that his statement was false.  He is scheduled to be sentenced on Dec. 15, 2011.

Cody Michael Reck, age 18 of Lake Ariel, PA pled guilty to one count of Recklessly Endangering Another Person, graded as a Misdemeanor of the 2  Degree and one count of Criminal Mischief-Damage Property, also graded as a Misdemeanor of the 2nd Degree.  The incident occurred on July 21, 2011, in Cherry Ridge Township when Reck and three co-defendants discharged a firearm, striking a private residence and numerous road signs. He is scheduled to be sentenced on Dec.15, 2011.

Stanley Ronald Jezorwski, Jr., age 32 of Scranton, PA pled guilty to one count of Fleeing or Attempting to Elude a Police Officer, graded as a Misdemeanor of the 2nd Degree.  The incident occurred on May 29, 2011, in Lehigh Township when Pennsylvania State Police observed Jezorwski traveling on a roadway with an ATV. He is scheduled to be sentenced on Dec.15, 2011.

Jerry W. Barrett, age 61 of Hawley, PA pled guilty to one count of Simple Assault, graded as a Misdemeanor of the 2nd Degree.  The incident occurred on July 26, 2011 in Hawley Borough when Barrett struck a female victim.  He is scheduled to be sentenced on Dec. 15, 2011.
Melissa Clair O’Heren, age 41 of Hawley, PA pled guilty to one count of Possession of Drug Paraphernalia, an ungraded Misdemeanor.  The incident occurred on June 13, 2011, in Texas Township when O’Heren was discovered to be in possession of Marijuana.  She is scheduled to be sentenced on Dec. 15, 2011.

John Vincent Zurlo, age 30 of Greentown, PA pled guilty to one count of DUI-Controlled Substance or Metabolite, an ungraded Misdemeanor.  The incident occurred on April 23, 2011, in Palmyra Township when Zurlo was discovered to be under the influence of Marijuana.  He is scheduled to be sentenced on Dec. 8, 2011.

Kyle Cass Edelmann, age 22 of Lake Ariel, PA pled guilty to one count of Theft By Unlawful Taking or Disposition, graded as a Misdemeanor of the 3rd Degree. The incident occurred on June 11, 2011, in Hawley Borough when Edelmann stole coins and jewelry from a private residence.  He is scheduled to be sentenced on Dec.15, 2011.

Paul B. Rainey, age 53 of Paupack Township pled guilty to one count of DU-Highest Rate, graded as a Misdemeanor of the 1 Degree.  The incident occurred on June 24, 2011, in Hawley Borough when Hawley Borough Police were called to investigate the report of an erratic driver.  His BAC was .207%.  He is scheduled to be sentenced on Dec. 15, 2011.

Jessica Erin Lehr, age 32 of Thompson, PA pled guilty to one count of Theft By Unlawful Taking or Disposition, graded as a Misdemeanor of the 3rd Degree. The incident occurred on May 14, 2011, in Mt. Pleasant Township when Lehr stole prescription medication from a private residence. She is scheduled to be sentenced on Dec.15, 2011.
