Stabbing incident brings year, state pen

The following cases were addressed July 9, 2009 by the Honorable Raymond L. Hamill, President Judge, Wayne County:
• Eric Paul Aylward, age 31 of Honesdale was sentenced to a State Correctional Institution for a period of  12 months to 36 months for one count of Aggravated Assault-Deadly Weapon, graded as a felony of the 2nd degree.
 The incident occurred on December 4, 2008, in Texas Township when Aylward stabbed a male victim several times. 
 He was also ordered to pay all Court costs, undergo a drug and alcohol evaluation together with a mental health evaluation and comply with all recommendations for treatment, and submit to the drawing of a DNA sample prior to being released from prison.
• Richard Montalvo, age 23 of Lake Ariel was sentenced to a State Correctional Institution for a period of  12 months to 60 months for one count of Burglary, graded as a felony of the 1st degree.
The incident occurred on January 27,2009, in Lake Township when Montalvo and two co-defendant’s kicked open the door of a private residence.  Upon gaining entry, Montalvo threatened to kill the victim. 
 He was also ordered to pay all Court costs, undergo a drug and alcohol evaluation together with a mental health evaluation and comply with all recommendations for treatment, attend an anger management program, obtain full time employment upon parole, $300.00 for the cost of the public defender and submit to the drawing of a DNA sample and pay $250.00 for the cost of the sample.
• Kelly Ann McAllister, age 40, of Waymart was sentenced to a State Correctional Institution for a period of  12 months to 36 months for one count of Criminal Trespass-Enter Structure, graded as a felony of the 3rd degree.
The incident occurred on February 3, 2009, in Waymart Borough when McAllister removed monies from a safe while serving as an employee at a local store. 
She was also ordered to pay all Court costs, restitution in the amount of $1,466.80, undergo a drug and alcohol evaluation and comply with all recommendations for treatment, continue with mental health treatment, have no contact with the co-defendant in this matter,  and pay $300.00 for the cost of the public defender. 
• Steven C. Falkenmeyer, age 42 of Deposit, NY was sentenced to a State Correctional Institution for a period of  12 months to 24 months for one count of Theft By Unlawful Taking or Disposition, a misdemeanor of the 1st degree.
 The incident occurred on September 22, 2008, in Scott Township when Falkenmeyer stole a vehicle.
He was also ordered to pay all Court costs, restitution in the amount of $1,300.00y $300.00 for the cost of the public defender, undergo a drug and alcohol evaluation and comply with all recommendations for treatment, and have no contact with the co-defendant in this matter.
