Defendants head to county lock-up

HONESDALE -

The following cases were addressed Thursday, January 8,  by the Honorable Raymond L. Hamill, President  Judge, Wayne County:
• Joseph Stegline, age 21 of Gouldsboro was sentenced to the Wayne County  Correctional Facility for a period of not less than 223 days nor more than 23 1⁄2 months    for one count of Receiving Stolen Property, graded as a Felony of the 3rd degree. 
The incident occurred on March 6, 2008, in Lehigh Township when Pennsylvania State Police found Stengline to be in possession of several stolen items. 
Herd was also ordered to pay all Court costs, restitution in the amount of $1,093.00,  perform 50 hours of community service, undergo a drug and alcohol evaluation and  comply with all recommendations for treatment, and obtain full time employment upon  parole.  
• John Erickson, age 31 of Honesdale was sentenced to Wayne County  Correctional Facility for a period of not less than 95 days nor more than 12 months  for one count of Possession of Drug Paraphernalia, an ungraded Misdemeanor. 
The incident occurred on August 16, 2007, in Honesdale Borough when  Erickson was found to be in possession of Heroin.   
He  was also ordered to pay all Court costs, $300.00 for the cost of the public defender,  perform 50 hours of community service, undergo a drug and alcohol evaluation and  comply with all recommendations for treatment, and obtain full time employment upon  parole. 
• Robert C. Allsop, age 30 of Honesdale was sentenced to the Wayne County  Correctional Facility for a period of not less than 30 days nor more than 23 1⁄2 months  for one count of Fleeing or Attempting to Elude a Police Officer, graded as a  Misdemeanor of the 2nd degree and one count of Driving While Operating Privileges  Suspended/Revoked, graded as a Summary offense. 
The incident occurred on June 29, 2008, in Honesdale Borough when  Honesdale Borough Police observed Allsop operating a vehicle while his operator’s  license was suspended. 
He was also ordered to pay all  Court costs, a fine in the amount of $200.00, and perform 50 hours of community  service. 
• Michael Anthony Ciccotelli, age 32 of Beach Lake was sentenced to the Wayne  County Correctional Facility for a period of not less than 90 days nor more than 5 years for one  count of DUI-Highest Rate, graded as a Misdemeanor of the 1st degree.
The incident occurred on June 7, 2008,  in Berlin Township when Pennsylvania State Police observed Ciccotelli fail to signal before  making a turn.  His BAC was .188%. 
 He was also ordered to pay all Court costs, a fine in the amount of $1,500.00, attend an alcohol highway safety  program, and perform 50 hours of community service. 
• Daniel A. Curtis, age 24 of Lake Ariel was sentenced to the Wayne County  Correctional Facility for a period of not less than 7 days nor more than 1 year for one count of  Possession of Controlled Substance, an ungraded Misdemeanor.
The incident occurred on July 6, 2008, in Lake Township when Pennsylvania State Police observed Curtis fail to stop at a posted intersection.  At that time Curtis was discovered to be in possession of Marijuana. 
 He was also ordered to pay all Court costs,  pay $300.00 for the cost of the public defender, undergo a drug and alcohol evaluation and comply with all recommendations for treatment, attend and complete an alcohol highway safety program, and perform 50 hours of community service.
•  James S. Battaglia, age 30 of Waymart was sentenced to the Wayne County  Correctional Facility for a period of not less than 10 days nor more than 12 months for one count of Fleeing or Attempting to Elude a Police Officer, graded as a Misdemeanor of the 2nd  Degree, One count of Recklessly Endangering Another Person, graded as a Misdemeanor of  the 2nd degree, one count of Reckless Driving, graded as a Summary offense, one count of  Exceed 65 MPH For All Vehicles by 56 MPH, graded as a Summary offense, and one count of  Failure To Stop At Red Signal, also graded as a Summary offense. 
 The incident occurred on June 16, 2008, in Sterlingupack and Lake Townships  when Pennsylvania State Police observed Battaglia speeding.  At that time Battaglia failed to  stop the vehicle after being given signals to do so.  He ran a red light and continued to travel at  a high rate of speed for several miles before finally surrendering to authorities.
He was also ordered to  pay all Court costs, a fine in the amount of $1,239.50, and perform 50 hours of community  service.
• Robert A. Colucci, age 53 of Honesdale was sentenced to the Wayne County Prison for a period of not less than 10 days nor more than 6 months for one count of DUI-Highest Rate, an ungraded Misdemeanor.
The incident occurred on April 24, 2008, in Texas Township when Pennsylvania State Police were called to investigate the report of a two vehicle crash.  His BAC was.232%. 
 He was also ordered to pay all Court costs, $300.00 for the cost of the public defendery a fine in the amount of $1,000.00, restitution in the amount of $126.12, and attend and complete an alcohol highway safety program.
• Pamela Sue German, age 24 of Greentown was sentenced to the Wayne County Correctional Facility for a period of not less than 30 days nor more than 23 1/2 months for one count of Recklessly Endangering Another Person, graded as a Misdemeanor of the 2nd degree and one count of DUI-Cont Sub-Impaired Ability/1stnd Offense, an ungraded Misdemeanor. 
 The incident occurred on May 16, 2008, in Salem Township when Pennsylvania State Police were called to investigate the report of a one vehicle crash.  At that time German was traveling with a minor child in the vehicle.  She was also discovered to be under the influence of illicit drugs. 
She was also ordered to pay all Court costs,         pay $300.00 for the cost of the public defendery a fine in the amount of $1,000.00, and undergo a drug and alcohol evaluation together with a mental health evaluation and comply with all recommendations for treatment.
• Levi Jones, age 21 of Moscow was sentenced to the Wayne County Correctional Facility for a period of not less than 6 months nor more than 23 1⁄2 months for one count of Possession of Controlled Substance With Intent to Deliver, an ungraded Felony. 
The incident occurred on April 4, 2008, in Salem Township when Jones and a co-defendant sold Vicodin and Percocet pills to a confidential informant. 
He was also ordered to pay all Court costs, restitution in the amount of $110.00, undergo a drug and alcohol evaluation together with a mental health evaluation and comply with all recommendations for treatment,  provide a DNA sample and pay $250.00 for the cost of the sample, and obtain part time employment upon parole.
• Elizabeth Connolly, age 19 of Moscow was sentenced to the Wayne County Correctional Facility for a period of not less than 10 days nor more than 12 months for one count of Unlawful Acts/Not Licensed as Pharamacist, an ungraded Misdemeanor. 
 The incident occurred on April 4, 2008, in Salem Township when Connolly and a co-defendant sold Vicodin and Percocet pills to a confidential informant. 
She was also ordered to pay all Court costs, $300.00 for the cost of the public defendery restitution in the amount of $110.00, perform 25 hours of community service and undergo a drug and alcohol evaluation and comply with all recommendations for treatment.
• Matthew Hunt, age 20 of Wilkes-Barre was sentenced to the Wayne County Correctional Facility for a period of not less than two months nor more than 12 months for one count of False Identification to Law Enforcement Authorities, graded as a Misdemeanor of the 3rd degree, one count of Purchase, Consumption, Possession or Transport, graded as ard Summary offense, and Littering Near Waterways, graded as Summary of the 3rd degree.
 The incident occurred on April 22, 2008, in Clinton Township when an officer from the Pennsylvania Fish and Boat Commission observed Hunt’s vehicle parked in an area where motor vehicles were prohibited.  
 Herd was also ordered to pay all Court costs, a fine in the amount of $125.00, undergo a drug and alcohol evaluation and comply with all recommendations for treatment, and perform 75 hours of community service.
• Jessica Gladys Burd, age 32 of Dunmore was sentenced to the Wayne County Correctional Facility for a period of not less than 15 days nor more than 12 months for one count of Retail Theft-Take Merchandise, graded as a Misdemeanor of the 2nd degree.
 The incident occurred on July 18, 2008, in Salem Township when Burd removed several items from a local store without paying for same.
 She was also ordered to pay all Court costs, $300.00 for the costnd of the public defendery restitution in the amount of $16.00, and undergo a drug and alcohol evaluation together with a mental health evaluation and comply with all recommendations for treatment.
