The following defendants were sentenced to Wayne County Prison Thursday, July 9, 2009. The Honorable Raymond L. Hamill, presided.
• Janice Dee Davis, age 29 of Honesdale was sentenced to the Wayne County Correctional Facility for a period of seven months to 23 1⁄2 months, in three separate cases, to one count of Possession of Controlled Substance, an ungraded misdemeanor, one count of Criminal Conspiracy-Engaging, graded as a misdemeanor of the 3rd degree, and one count of Forgery, graded as a felony of the 3rd degree.
The first incident occurred on December 27, 2007, in Honesdale Borough when Honesdale Borough Police found Davis to be in possession of needles, smoking devices, pills and a spoon. The second incident occurred on January 18, 2008, in Honesdale Borough when Davis conspired with three co-defendant’s to take money from a stolen purse. The third incident occurred on February 20, 2008, in Paupack Township when Davis stole several checks from a private residence. Davis later forged the checks and cashed them.
She was also ordered to pay all Court costs, restitution in the amount of $1,150.00, undergo a drug and alcohol evaluation together with a mental health evaluation and comply with all recommendations for treatment, obtain full time employment upon parole, and provide a DNA sample and pay $250.00 for the cost of the sample.
• Frank Michael Piccolo, age 20 of Lake Ariel was sentenced to the Wayne County Correctional Facility for a period of six months to 18 months, followed by five years probation, for three counts of Indecent Assault-Complainant Less Than 13 Years -Intimate Parts, graded as misdemeanors of the 1st degree, and one count of Indecent Assault-Complainant Less Than 13 Years-Intimate Parts, graded as a felony of the 3rd degree.
The incidents occurred between October 1, 2007, and October 1, 2008, in Lake Township when Piccolo had indecent contact with a minor child.
He was also ordered to pay all Court costs, undergo a drug and alcohol evaluation together with a mental health evaluation and comply with all recommendations for treatment, under a sex offender evaluation and comply with all recommendations for treatment, submit to the drawing of a DNA sample prior to being released from prison, have no contact with the victim in this matter, and have no unsupervised contact with anyone under the age of 18.
