Attorneys delivered closing statements Monday morning in the trial of Susan Pevec, 30, the Browndale woman accused of burning her 14 month-old son in an attempt to gain full custody of the child. She was fouund guilty on most counts.
“I don’t know is O.K.,” Randy Borden, Pevec’s attorney said, addressing the jury. “It is not your job to support a guess,” this he said speaking to the circumstantial nature of the evidence and testimony presented in the case by the prosecution.
Assistant District Attorney Patrick Robinson, in his address, showed the jury pictures of the burns on the child, as well as a picture of the child’s father, Christopher White, of Johnson City, NY, holding a smiling child just hours before the burns were discovered by the Pevec family, clutching the child right where the burns are said to have been sustained. “If that’s not telling, I don’t know what is,” said Robinson.
Robinson also showed video of White’s father returning the child to the Pevec home and being confronted by an angry Susan Pevec about suppositories the Whites supposedly placed in the child’s diaper, evidencing sexual abuse according to Pevec. The video tape was a crucial piece of evidence in the charge that Pevec misused a wire or recording device, violating White’s privacy without his consent.
No less, as Borden told the jury, “The burden of proof rests with the prosecution.”
After four hours and 45 minutes of deliberation, the jury found Pevec guilty on six of the seven counts, including endangering the welfare of a child, intercepting a wire—both felonies—two counts of false reports and two counts of simple assault. The only charge Pevec was found not guilty for was that of fabricating evidence. The charges represent a maximum penalty of 21 years in prison, according to Robinson.
In addition, Pevec’s bail was set at $75k and her visitation and custody of the child has been suspended.
She is set to be sentenced on September 4th, 2008.
