  • Three plead in big drug case

  • The following drug related cases were addressed by the Honorable Robert J. Conway, Senior Judge, Specially Presiding, Wayne County, on June 27.

  • — The following drug related cases were addressed by the Honorable Robert J. Conway, Senior Judge, Specially Presiding, Wayne County, on Thursday.
    The following three Defendants were charged as a result of a joint investigation by the Pennsylvania State Police and the Wayne County Drug Task Force. Confidential Informants were utilized to make controlled purchases of drugs from the Defendants.
    DANIEL R. DIBENEDETTO, age 24 of Honesdale, PA pleaded guilty, in two separate cases, to one count of Delivery of Controlled Substance, an ungraded Felony and two counts of Possession of Controlled Substance, ungraded Misdemeanors. On November 18, 2012, Dibenedetto sold 100 bags of Heroin for $700.00 at a residence on Terrace Street in Honesdale. On December 5, 2012, Dibenedetto sold 100 bags of Heroin for $625.00 outside a residence on Westside Avenue in Honesdale. When Dibenedetto was arrested on February 15, 2013, he was in possession of twelve (12) bags of Heroin and $1,560.00 in cash. Dibenedetto faces a possible maximum sentence of 17 years in jail and a fine of $260,000.00.
    ALEJANDRO E. VELA-GARRETT, age 18 of Newfoundland, PA pleaded guilty to one count of Persons Not to Possess, Use, Firearms, Etc., graded as a Felony of the 2nd Degree and one count of Criminal Conspiracy-Delivery of Controlled Substance, an ungraded Felony. On March13, 2013, Vela-Garrett sold seven (7) Percocet pills for $210.00. The sale took place in a gas station parking lot in Newfoundland. Later that same day a search warrant was served on Vela-Garrett's residence. After the law enforcement officers entered the residence Vela-Garrett was found to be hiding in the basement. Vela-Garrett was determined to be in possession of an AR-15, an AK-47, a Taurus pistol, and $1,470.00 in cash of which $210.00 was the "buy money" used to purchase the Percocet. Vela-Garrett was prohibited from possessing a firearm due to his prior criminal record which included a Juvenile Felony Adjudication in Florida forBurglary of a Dwelling. Vela-Garrett faces a possible maximum sentence of 25 years in prison and a fine of $275,000.00.
    NICHOLAS ARTHUR HUEBNER, age 23 of Honesdale, PA pleaded guilty, in two separate cases, to one count of Delivery of Controlled Substance, an ungraded Felony and one count of Possession of Controlled Substance with Intent to Deliver, also an ungraded Felony. On February 26, 2013, Huebner sold ten (10) bags of Heroin for $200.00. The sale took place on North Main Street near the Library in Honesdale. When Huebner was arrested on April 4, 2013, he was in possession of 73 bags of Heroin and $467.00 cash. He admitted that he made multiple trips to Patterson, NJ every week to buy Heroin for himself and for resale. Huebner faces a maximum of thirty years in prison and a fine of $500,000.00.
    Page 2 of 2 - At the conclusion of the Guilty Pleas, Judge Conway revoked the bail on all three Defendants and remanded them to the Wayne County Correctional Facility. Dibenedetto and Vela-Garrett are scheduled to be sentenced on August 8, 2013 and Huebner is scheduled to be sentenced on August 15, 2013.
