  • The following cases were addressed recently by the Honorable Raymond L. Hamill, President Judge, Wayne County:
    JAMES MICHAEL TALARICO, age 24 of Lake Ariel, PA was sentenced to the Wayne County Correctional Facility for a period of not less than 3 months nor more than 23 1/2 months for one count of Theft By Unlawful Taking or Disposition, graded as a Misdemeanor of the 1st Degree. He was also ordered to pay all Court costs, pay restitution in the amount of $498.00, have no contact with the victim in this matter, comply with all recommendations of Children & Youth services, continue with drug and alcohol treatment, attend a minimum of 1 AA meeting per week, perform 100 hours of community service, and obtain full time employment upon being released from prison.
    The incident occurred on November 24, 2011, in Paupack Township when Talarico stole jewelry from a private residence.
    HARVEY ERIC LOEB, age 74 of Lake Ariel, PA was sentenced to the Wayne County Correctional facility for a period of not less than 30 days nor more than 6 months for one count of DUI, an ungraded Misdemeanor. He was also ordered to pay all Court costs, pay a fine in the amount of $750.00, undergo a drug and alcohol evaluation and comply with all recommendations for treatment, attend and complete an alcohol highway safety program, attend a minimum of 4 AA meeting per week, continue with mental health treatment and perform 50 hours of community service. The incident occurred on February 17, 2012, in Salem Township when Pennsylvania State Police were called to investigate the report of a two vehicle crash. His BAC was .148%.
    KENNETH DELCASTILLO, age 32 of Wilkes-Barre, PA was sentenced to the Wayne County Correctional Facility for a period of not less than 3 months nor more than 12 months for one count of Harassment-Communicate Lewd, Threatening Etc., graded as a Misdemeanor of the 3rd Degree. He was also ordered to pay all Court costs, pay a fine in the amount of $500.00, undergo a drug and alcohol evaluation and comply with all recommendations for treatment, have no contact with the victim in this matter, and attend an anger management program. The incident occurred between March 16, 2012, and March 17, 2012, in Salem Township when Delcastillo made several threatening telephone calls to a male victim.
    ROGER DALE MILLER, age 34 of Wilkes-Barre, PA was sentenced to the Wayne County Correctional Facility for a period of not less than 72 hours nor more than 6 months, followed by 6 months probation for one count of DUI: Cont Substance/Combin Alcohol-1st Offense, an ungraded Misdemeanor and one count of Possession of Controlled Substance, also an ungraded Misdemeanor. He was also ordered to pay all Court costs, pay a fine in the amount of $1,500.00, attend and complete an alcohol highway safety program, undergo a drug and alcohol evaluation together with a mental health evaluation and comply with all recommendations for treatment.
    Page 2 of 5 - The incident occurred on July 17, 2011, in Palmyra Township when Hawley Borough Police observed Miller traveling in an erratic manner. His BAC .013%. Miller was also under the influence of several controlled substances at that time. Miller was also discovered to be in possession of a pipe.
    AMANDA LEE MEHRTENS, age 28 of Tafton, PA was placed on probation for a period of 18 months for one count of Recklessly Endangering Another Person, an ungraded Misdemeanor, one count of Theft By Unlawful Taking or Disposition, graded as a Misdemeanor of the 3rd Degree and one count of Theft By Unlawful Taking or Disposition, graded as a Misdemeanor of the 2nd Degree. She was also ordered to pay all Court costs, pay restitution in the amount of $94.97 and undergo a drug and alcohol evaluation and comply with all recommendations for treatment. The incident occurred on May 14, 2012, in Bethany Borough when Mehrtens stole prescription medication belonging to another.
    PAUL CHARLES KEESLER, age 49 of Honesdale, PA was sentenced to the Wayne County Correctional Facility for a period of not less than 10 days nor more than 6 months for one count of DUI-Highest Rate, an ungraded Misdemeanor. He was also ordered to pay all Court costs, pay a fine in the amount of $1,000.00, continue with drug and alcohol treatment, and attend and complete an alcohol highway safety program.
    The incident occurred on April 12, 2012, in Texas Township when Pennsylvania State Police observed tinted windows on the vehicle Keesler was traveling in. His BAC was .171%.
    BARRY ROB MCFARLAND, age 19 of Drums, PA was placed on probation for a period of 18 months for one count of Criminal Trespass-Break Into Structure, graded as a Felony of the 2nd Degree and one count of Resisting Arrest or Other Law Enforcement, graded as a Misdemeanor of the 2nd Degree. He was also ordered to pay all Court costs, pay a fine in the amount of $500.00 and have no contact with the co- defendants in this matter. The incident occurred on August 26, 2011, in Lehigh Township when McFarland and two co-defendants broke into a barn.
    RYAN M. SOULS, age 22 of Prompton, PA was placed on probation for a period of 6 months for one count of Fleeing or Attempting to Elude a Police Officer, graded as a Misdemeanor of the 2nd Degree, one count of Reckless Driving, graded as a Summary offense and one count of Exceed 35 MPH in Urban District by 30 MPH, also graded as a Summary offense. He was also ordered to pay all Court costs, pay a fine in the amount of $650.00, and perform 50 hours of community service. The incident occurred on April 18, 2012, in various locations in Wayne County, when Souls led Honesdale Borough Police on a car chase.
    PRAGNESH V. PATEL, age 35 of Honesdale, PA was ordered to pay all Court costs and a fine in the amount of $500.00 for one count of Possession of Controlled Substance, an ungraded Misdemeanor. The incident occurred between March 7, 2012, and March 8, 2012, in Honesdale Borough when Patel was in possession of synthetic Marijuana.

The incident occurred on March 7, 2012, in Honesdale Borough when Patel was discovered to be in possession of synthetic Marijuana.
    GREGORY JOSEPH MOYLES, age 44 of Rowland, PA was sentenced to the Wayne County Correctional Facility for a period of not less than 10 days nor more than 6 months for one count of DUI-Highest Rate, an ungraded Misdemeanor and one count of Accident Involving Damage to Attended Veh/Property, graded as a Misdemeanor of the 3rd Degree. He was also ordered to pay all Court costs, pay a fine in the amount of $1,300.00, undergo a drug and alcohol evaluation and comply with all recommendations for treatment, and attend and complete an alcohol highway safety program. The incident occurred on April 20, 2012, in Salem Township when Pennsylvania State Police were called to investigate the report of a two vehicle crash. His BAC was .255%.
    CRYSTAL LOUISE SIMPKINS, age 33 of Lake Ariel, PA was sentenced to the Wayne County Correctional Facility for a period of not less than 6 months nor more than 23 1/2 months for one count of Criminal Mischief-Damage Property, graded as a Misdemeanor of the 2nd Degree. She was also ordered to pay all Court costs, and undergo a drug and alcohol evaluation together with a mental health evaluation and comply with all recommendations for treatment. The incident occurred on June 4, 2012, in Salem Township when Simpkins pushed her way into a private residence, breaking the door and smashing windows.
    KYLE CONKLIN, age 19 of Prot Jervis, NY was sentenced to the Wayne County Correctional Facility for a period of not less than 144 days nor more than 23 1/2 months for one count of Possession of Controlled Substance With Intent to Deliver, an ungraded Misdemeanor and one count of Theft By Unlawful Taking or Disposition, graded as a Misdemeanor of the 1st Degree. He was also ordered to pay all Court costs, pay a fine in the amount of $500.00, undergo a drug and alcohol evaluation together with a mental health evaluation and comply with all recommendations for treatment and obtain part time employment. The incident occurred on June 10, 2012, in Texas Township when Conklin stole prescription medication from a private residence.
    ANITA M. STANGER, age 48 of Lake Ariel, PA was placed on the Accelerated Rehabilitative Disposition Program for a period of 6 months related to DUI. He was also ordered to pay all Court costs, attend and complete an alcohol highway safety program, perform 40 hours of community service and have his operator’s license suspended for a period of 60 days. The incident occurred on May 19, 2012, in Lake Township when Pennsylvania State Police were called to investigate the report of a one vehicle crash. His BAC was .240%.

He was also ordered to pay all Court costs, attend and complete an alcohol highway safety program, perform 40 hours of community service, and have his operator’s license suspended for a period of 60 days. The incident occurred on June 16, 2012, in Clinton Township when Pennsylvania State Police were called to investigate the report of a one vehicle crash. His BAC was .197%.
    ROBERT MICHAEL VONSON, age 21 of Carbondale, PA pled guilty to one count of DUI-Highest Rate, graded as a Misdemeanor of the 1st Degree. The incident occurred on March 24, 2012, in Canaan Township when Pennsylvania State Police were called to investigate the report of a one vehicle crash. His BAC was .192%. He is scheduled to be sentenced on February 7, 2013.
    JOSEPH JOHN WILLIAMS, age 32 of Lake Ariel, PA pled guilty to one count of DUI- Highest Rate, an ungraded Misdemeanor. The incident occurred on April 22, 2012, in Salem Township when Pennsylvania State Police were called to investigate the report of a one vehicle crash. His BAC was .402%. He is scheduled to be sentenced on February 7, 2013.
    THOMAS VITALE, age 34 of Honesdale, PA pled guilty to one count of Possession of Drug Paraphernalia, an ungraded Misdemeanor. The incident occurred on April 9, 2012, in Honesdale Borough when Honesdale Borough Police observed Vitale traveling with an expired inspection sticker. At that time Vitale was in possession of a pipe. He is scheduled to be sentenced on February 14, 2013.
    RICHARD ALLEN LEMBCKE, age 28 of Honesdale, PA pled guilty to one count of Criminal Trespass-Break Into Structure, graded as a Felony of the 2nd Degree. The incident occurred between July 6, 2012, and July 9, 2012, in Lake Township. He is scheduled to be sentenced on February 14, 2013.
    TODD DOUGLAS BURKHARDT, age 46 of Hawley, PA pled guilty to one count of DUI: Cont Substance/Combin Alcohol-1st Offense, an ungraded Misdemeanor. The incident occurred on December 16, 2011, in Hawley Borough when Hawley Borough Police observed Burkhardt traveling at a high rate of speed. Burkhardt was under the influence of Marijuana at that time. He is scheduled to be sentenced on February 14, 2013.
    BRIAN S. FISHERMAN, age 24 of Beach Lake, PA pled guilty to one count of Simple Assault, graded as a Misdemeanor of the 2nd Degree and one Count of Recklessly Endangering Another Person, also graded as a Misdemeanor of the 2nd Degree. The incident occurred on August 9, 2012, in Damascus Township Fisherman assaulted a female victim. He is scheduled to be sentenced on February 7, 2013.
    SCOTT RYAN, age 37 of Lake Como, PA pled guilty to one count of DUI-Highest Rate, an ungraded Misdemeanor. The incident occurred on June 25, 2012, in Mt. Pleasant Township when Pennsylvania State Police were called to investigate the report of a vehicle stopped in the roadway. He is scheduled to be sentenced on February 14, 2013.
    Page 5 of 5 - JOSEPH ROBERT CIACCIO, age 23 of Hawley, PA pled guilty to one count of Criminal Trespass-Enter Structure, graded as a Felony of the 3rd Degree. The incident occurred June 8, 2012, in Paupack Township when Ciaccio entered a private residence knowing he did not have permission to do so. He is scheduled to be sentenced on February 7, 2013.
