Wayne County Commissioners approved the use of Eminent Domain to claim ownership of a piece of private property in the village of Equinunk, Manchester Township.


Wayne County Commissioners approved the use of Eminent Domain to claim ownership of a piece of private property in the village of Equinunk, Manchester Township.

The piece of property is a narrow strip of land adjacent to an existing right-of-way. It would represent a small expansion of the existing right-of-way.

The property is being claimed to finalize the Kellam’s Bridge replacement project.

Eminent Domain was used because an agreement on the proper amount of compensation was not reached, said Commissioner Wendell Kay. The amount will now be decided in the Court of Common Pleas. 

Property owners Georges and Lisa Krivobok, of Brooklyn, NY, could not be reached for comment.

Eminent Domain is the right of government to take property from a private owner for public use by virtue if the superior dominion of its sovereignty over all lands within its jurisdiction.

The United States Constitution requires the government to compensate the owner of the property taken under Eminent Domain.
