The following misdemeanor cases were addressed Thursday, November 19, 2009 by the Honorable Raymond L. Hamill, Preside Judge Wayne County.


The following misdemeanor cases were addressed Thursday, November 19, 2009 by the Honorable Raymond L. Hamill, Preside Judge Wayne County.
Four months
• Casey Michael Ivosevic, age 29 of Wilkes-Barre was sentenced to the Wayne County Correctional Facility for four months to 23/12 months for one count of Possession of Controlled Substance, an ungraded misdemeanor. He was also ordered to pay all Court costs, a fine in the amount of $500.00, perform 50 hours of community service and undergo a drug and alcohol evaluation and comply with all recommendations for treatment. 
The incident occurred on January 6, 2009, in Palmyra Township when Pennsylvania State Police observed Ivosevic traveling with tinted windows.  At that time Ivosevic was found to be in possession of Oxycontin for which he did not possess a valid prescription.
• Colleen McKee Bakker, age 21 of Lakeville was sentenced to the Wayne County Correctional Facility for four months to 12 months for one count of Possession of Controlled Substance, an ungraded misdemeanor. She was also ordered to pay all Court costs, undergo a drug and alcohol evaluation together with a mental health evaluation and comply with all recommendations for treatment, and obtain full time employment.
 The incident occurred on June 17, 2009, in Paupack Township when Wayne County Probation Department conducted a field check and found Bakker to be in possession of a syringe and Heroin.
Three months
• Gregory Warren Holmes, age 45 of Waymart was sentenced to the Wayne County Correctional Facility for three months nor more six months for one count of DUI, an ungraded misdemeanor.  He was also ordered to pay all Court costs, pay a fine in the amount of $500.00, undergo a drug and alcohol evaluation and comply with all recommendations for treatment,  and attend an alcohol highway safety program.
The incident occurred on July 4, 2008, in Lehigh Township when Pennsylvania State Police observed Holmes fail to dim his headlights. His BAC was .144%. 
Two months
• Patrick Jesus O’Heren, age 57 of Hawley was sentenced to the Wayne County Correctional Facility for two months to 23 1/2  months for two counts of Recklessly Endangering Another Person, graded as misdemeanors of the 2nd degree and one count of Arson-Dangerous Burning, graded as a summary offense. He was also ordered to pay all Court costs, a fine in the amount of $700.00, and undergo a mental health evaluation and comply with all recommendations for treatment.
The incident occurred on May 11, 2009, in Hawley Borough when O’Heren set fire to a residence. 
• Jody Laverrne Hanson, age 35 of Honesdale was sentenced to the Wayne County Prison for 60 days to 12 months for one count of False Reports to Law Enforcement Authorities, graded as a misdemeanor of the 3rd degree.  He was also ordered to pay all Court costs, a fine in the amount of $1,000.00, pay $300.00 for the cost of the public defender, obtain full time employment and undergo a drug and alcohol evaluation and comply with all recommendations for treatment. 
The incident occurred on April 4, 2009, in Berlin Township when Hanson reported his vehicle stolen to Pennsylvania State Police.  It was later discovered that Hanson’s vehicle had not been stolen. 
One month
• Gerard Patrick Miserandino, age 37 of Beach Lake was sentenced to the Wayne County Correctional Facility for 30 days to six months for one count of DUI, an ungraded misdemeanor.  He was also ordered to pay all Court costs, a fine in the amount of $750.00, perform 50 hours of community service, $300.00 for the cost of the public defender, and attend and complete an alcohol highway safety program.  The incident occurred on May 25, 2009, in Berlin Township when Pennsylvania State Police observed Miserandino traveling without any tail lights.  His BAC was .116%.
Under one month
• Paul Michael Cosgrove, age 46 of Lake Ariel was sentenced to the Wayne County Correctional Facility for five days to six months for one count of DUI, an ungraded misdemeanor. He was also ordered to pay all Court costs, a fine in the amount of $600.00, undergo a drug and alcohol evaluation together with a mental health evaluation and comply with all recommendations for treatment, and  attend and complete an alcohol highway safety program. 
The incident occurred on April 29, 2009, in Salem Township when Pennsylvania State Police were called to assist Hideout Security Officers with male suspected of DUI. Cosgrove’s BAC was .158%.
• Hazel Smith, age 29 of Simpson was sentenced to the Wayne County Correctional Facility for five days to six months followed by 12 months of probation  for one count of DUI: Controlled Substance, an ungraded misdemeanor, one count of Fleeing or Attempting to Elude a Police Officer, graded as a misdemeanor of the 2nd degree, and one count of Recklessly Endangering Another Person, also graded as and misdemeanor of the 2nd degree.  She was also ordered to pay all Court costs, a fine in the amount of $1,000.00, undergo a drug and alcohol evaluation and comply with all recommendations for treatment, attend and complete an alcohol highway safety program, continue with mental health treatment, attend an anger management program and obtain full time employment.
 The incident occurred on May 30, 2009, in Clinton Township when Pennsylvania State Police were called to investigate the report of a one vehicle crash after the Smith fled from the Carbondale Police. Her BAC was .122%.
